Key Highlights of Law No. 70/2025/QH15 and Decree No. 22/2026/NĐ-CP
The amended Law on Standards and Technical Regulations (Law No. 70/2025/QH15) together with Decree No. 22/2026/NĐ-CP, which provides detailed provisions and measures for implementation, have officially been promulgated. These legal instruments establish a coherent, transparent, and practical framework, addressing previous shortcomings while enhancing the effectiveness of regulatory management in the new era.

In the context of deepening international economic integration, standards and technical regulations serve as the “common language” of global trade, determining market access and competitiveness of enterprises. The rise of technical barriers to trade, coupled with growing demands for transparency, product safety, and sustainable development, has made it imperative to modernize the legal framework for standards and technical regulations in line with international practices.

Harmonization with International Standards
The revised law strengthens the alignment of Vietnam’s standards and technical regulations with international and regional benchmarks. This move enhances the competitiveness of Vietnamese goods in global markets and reduces technical barriers to trade, paving the way for businesses to join global supply chains.

Reformed Standard-Setting Process
A major innovation lies in streamlining administrative procedures and ensuring greater transparency. The law requires broad consultation with stakeholders, especially the business community, and introduces mechanisms for impact assessment and social feedback before adoption. These measures aim to improve both the quality and feasibility of standards and regulations.

Promoting Social Participation
The law encourages enterprises, associations, and social organizations to actively participate in developing national standards. The government is shifting from a “doing on behalf” role to one of “guidance and support,” thereby mobilizing social resources and empowering businesses to take initiative in applying standards.

Digital Transformation in Standardization
Information technology and digital transformation are emphasized as key drivers. A national database of standards and regulations will be established, enabling online publication and access. Integration with other government information systems will modernize administration, reduce costs, and improve efficiency.

Clearer Division of Responsibilities
The law clarifies the responsibilities of ministries, agencies, and local authorities, enhancing decentralization while ensuring unified implementation nationwide. The duties of lead agencies in drafting standards and regulations are more explicitly defined.

Linking Standards with Innovation and Productivity
Standardization is closely tied to improving productivity, quality, and innovation. The government will support enterprises in adopting advanced standards, thereby boosting competitiveness and sustainable growth in an economy increasingly driven by science, technology, and innovation.

Shift from Pre-Inspection to Post-Inspection
The law strengthens inspection and supervision while moving from pre-approval to post-check mechanisms. This reduces administrative burdens for businesses while maintaining effective oversight through audits, inspections, and enforcement.

Decree No. 22/2026/NĐ-CP: Detailed Implementation
Building on the law, the decree specifies management responsibilities, clarifies authority for issuing and updating technical regulations, and prevents overlaps among ministries. It also standardizes management practices, shifting from administrative control to data- and criteria-based oversight. Digital platforms will be used for publishing standards, certifications, and conformity assessments. Transparency in production activities—such as mandatory disclosure of conformity and traceability—will help resolve past difficulties and ensure consistent application nationwide.

Conclusion
Law No. 70/2025/QH15 and Decree No. 22/2026/NĐ-CP mark a significant step forward in modernizing Vietnam’s legal framework for standards and technical regulations. Their effective implementation will strengthen product quality, protect consumers, and foster sustainable socio-economic development in the years ahead.

In the afternoon of May 27, 2025, Can Tho City Department of Science and Technology held a meeting of the Advisory Council to evaluate and accept the results of the implementation of the scientific and technological project "Research on diversifying processed products from jackfruit (Artocarpus heterophyllus Lam)." The project was carried out by Associate Professor, Dr. Bach Long Giang. Nguyen Tat Thanh University was an implementing agency; Science and Technology Advances Application Center, Vietnam - Korea Industrial Technology Incubator were coordinating units.
